Bug#374929: tomcat will not stop using the init script /etc/init.d/tomcat5 stop

I can not stop tomcat using the init script.  Here are the commands I
have issued and the response:

$ sudo /etc/init.d/tomcat5 stop
Stopping Tomcat 5 servlet engine: (not running).
$ ps ax | grep tomcat
28289 ?        S      0:04 /opt/jdk1.5.0_06//bin/java
-Djava.awt.headless=true -Xmx128M
-Djava.endorsed.dirs=/usr/share/tomcat5/common/endorsed -classpath
