I've found JCR 1.0 API (javax.jcr package) licence here :
http://www.day.com/specs/jcr/1.0/license.html
It's exactly the same one as JCR 2.0...

From a quick overview, it seems clearly *non-free* as it :

- fails DFSG §3 (derivative work)
  License for the Distribution [...]
  No license is granted hereunder for any other purpose (including, for
  example, modifying the Specification[...]

- fails DFSG §1 (free redistribution)
  License for the Distribution [...]
  No license is granted hereunder for any other purpose (including,
  for example, [...] distributing the Specification to third parties).

- maybe, also, fails with DFSG §9
Must not place restrictions on other software that is distributed along with 
the licensed software

  Pass-through Conditions. [...] You may neither: (a) [...];
  nor (b) authorize your licensees to make any claims
  concerning their implementation's compliance with the Specification.

  [not sure it fails DFSG §9, but seems a bit weird to me]

From what I've found, Apache Software Foundation (Legal Affairs) as already 
marked this issue as "solved" [1] [2]. Really sad....
