This looks to me like a bug in the cifs client (i.e., the kernel), for
incorrectly mapping an NT_STATUS_NOT_IMPLEMENTED return to EACCES instead of
EOPNOTSUPP.

Do you have POSIX ACLs enabled on the server?  Turning them on as a mount
option for the underlying filesystem would be the quickest way to resolve
this bug, I think; and if that works then we know this bug report should be
reassigned to the CIFS driver.
