this is fixed in user-mode-linux (2.6.16-1um-1), see its changelog:

      * added myself to the uploaders
	  * fixed dependency on module-init-tools for kernel 2.6
	  * using dpatch to apply patches, current patches are:
		- 01_uml_net
		- 02_x-terminal-emulator
	  * updated config for 2.6.16
