That comment doesn't apply to Splashy anymore. splashy-init will
detect that /proc is not mounted yet and it will wait until it is
mounted before starting Splashy.

Yep. splashy-init uses black magic ...

Perhaps the comment should say:

# splashy-init takes care of waiting for /proc to be mounted. we are
starting Splashy as early as possible for now, and letting
splashy-init handle it after /proc is mounted
