georg at vaio:~$ df | grep init
tmpfs                   517792         0    517792   0% /lib/init/rw

I guess it's more a matter of _when_ it's mounted with read-write access. 
Afterall, splashy works fine when shutting down.

Yes, linux-image-2.6.18-3-686 (2.6.18-7).
